Privacy Policy

Welcome to FINEXXE, an interactive platform for reading, writing, sharing, and publishing. “The Company” or “the Company” or “the platform” or “we” or “us” or “our” refers to FINEXXE and all its divisions, successors, partners, agents, principals, representatives, third-party providers, employees, associates of all forms, and its mobile application(s). “User” or “Users” or “You” or “you” or “your” shall refer to the user or subscriber to FINEXXE or to any person acting on behalf of the subscriber to FINEXXE. These names and pronouns shall be used in all variations of capitalization.

Agreement to these Terms and Conditions are mandatory for all users but does not grant you the right to copy, change, reproduce, sell or otherwise exploit these Terms and Conditions. If you fail to agree to these Terms and Conditions, you do not have the right to use FINEXXE’s services.

  1. Account Registration

All users need an account to access FINEXXE’s services. You may register for a reader account or an author account. Users who have an author account will be held to all the responsibilities connected with the user account and will have author responsibilities added to these.

We limit the content people are able to view without an account because FINEXXE’s interactive reading, writing, and publishing experience is personalized for each user. We also have a responsibility to the users who publish on our site, and in order to maintain their privacy and secure their rights, we must regulate how their content is exposed on our platform. Registration for a reader account involves:

  • Selecting a unique username
  • Selecting a password
  • Agreement to our Terms and Conditions
  • Agreement to our Privacy Policy
  • Agreement to our Code of Conduct

Registration for an author account involves:

  • Selecting a unique username
  • Selecting a password
  • Agreement to our Terms and Conditions
  • Acceptance of our Author Agreement
  • Agreement to our Privacy Policy
  • Agreement to our Code of Conduct

When you register for an author account, you become fully responsible for all the content published and activities performed on the account. This makes it especially important for you to keep your password secure in order to prevent others from using your account in objectionable ways or taking control of your account. FINEXXE accepts no liability or responsibility for the outcomes of compromised accounts, and we reserve the right to suspend or terminate accounts associated with misconduct according to our Code of Conduct or Content Restrictions & Guidelines. Should your account’s personal information become compromised, let FINEXXE’s support team know immediately. However, we do not guarantee our ability to restore the account to you, and in some cases, account termination might be our only course of action.

Do Not Share Login Details – AUTHOR ACCOUNT

 You agree that you will never share your login details for your Author account with any other person. It costs $1,000 – $5,000 to consult, edit, create a book design, encrypt, publish, and maintain the book on FINEXXE. If you compromise the security of the site and the ability of its owners and members to earn revenue, it costs the company and it costs you. Do not share your login details with anyone. Your account is for individual use only. Encourage your friends to support your work or your child’s work for them to buy a copy of the book.

Failure to comply may lead to the following consequences:

  • A fine ranging from between $1,000 and $5,000 USD for the services rendered to publish your work.
  • Suspension or termination of your Author account.
  • Withholding by FINEXXE of any outstanding revenue that accrued to your account.
  • Retaining by FINEXXE of the copyright for the novel, essay or any other materials until $5,000 in revenue is generated as outlined in condition: User Copyrights for FINEXXE’s Free Editing Services Option

Included in our effort to safeguard our authors’ work, we have employed the use of technology that allows us to detect unauthorized use of login information. Account sharing will not go unnoticed.

It is your responsibility to keep your account login information secure. While FINEXXE uses encryption and other security methods to guard against malicious activity, we cannot prevent security breaches that users cause by sharing or being careless with their password. Therefore, here are some further guidelines to follow to ensure that your account remains safe:

  • If you receive a request for your login or password, report this immediately to our support department at (INFO@FINEXXE.COM).
  • Do not write your password down, or if need be, secure the password in a private area.
  • Do not allow anyone to watch as you type your password.
  • Always log out when finished using your reader or author account.
  • Do not download software from unknown or unreliable sources. Some of these “free” programs may contain viruses, trojans, or phishing functions that might allow unauthorized persons to have access to your account without your knowing about it.

Do Not Share Login Details – READER ACCOUNT

You agree that you will never share your login details for your Reader account with any other person. If you compromise the security of the site and the ability of its owners and members to earn revenue, it costs the company and it costs you. Do not share your login details with anyone. Your account is for individual use only. Failure to comply will lead to the termination of your Reader account.

Encourage your friends to support the works of others and for them to purchase a copy of an eBook.

  1. Parental accounts for users under 18

All of FINEXXE’s primary users must be 18 years or older. This means, in order to sign up for FINEXXE’s services, you must be 18 years old or more. In order for persons younger than 18 to use our services, they must get parental consent.

  1. Publishing Options and the Responsibilities Attached to Each

All Content Published on FINEXXE must be processed by our editors. Users have two options for receiving editing services from FINEXXE. They may pay to have their manuscript edited or take advantage of FINEXXE’s free editing service. Manuscript editing costs range from $1000 to $3,000, but prices are subject to change based on market conditions. All prices, fees, and payments are quoted in U.S. dollars (USD). To qualify for the free editing option, users must get a certain number of pre-orders for their manuscripts. Details are given below:

FINEXXE’s Paid Editing Services Option

  1. Register for an author account.
  2. Pay editing fee.
  3. Sign FINEXXE’s Editing Agreement.
  4. Submit your manuscript draft and a synopsis of the manuscript for editing.
  5. Describe your desired cover design (optional).
  6. Review the edited manuscript our editors return to you.
  7. Publish your work on FINEXXE and start earning revenue (optional).

FINEXXE’s Free Editing Services Option

  1. Register for an author account. (Note: Your legal guardian will be required to make this payment if you’re under 18 years of age. See Parental accounts for users under 18.)
  2. Sign FINEXXE’s Editing Agreement.
  3. Submit a synopsis of your manuscript.
  4. Describe your desired cover design.
  5. FINEXXE will upload an edited synopsis and cover design for your pre-order page.
  6. Get pre-orders for your manuscript to qualify for full editing:

  1. Submit your manuscript for full editing.

Pre-order Requirement

The pre-order process is part of FINEXXE’s crowdfunding initiative, which allows authors to raise funds for their book projects. These funds will help pay their editing costs and can also help support them as they complete their manuscripts.

FINEXXE recommends that authors have their manuscript ready (or close to being ready) before beginning the process so that once the pre-order requirement is fulfilled, we can immediately begin editing to have the work published as quickly as possible.

  1. Copyright

Users’ copyright will differ depending on whether they have taken advantage of FINEXXE’s free editing service option or paid FINEXXE to have their manuscript edited.

User Copyrights for FINEXXE’s Free Editing Services Option

  • After editing is complete, the user grants FINEXXE exclusive publication rights.
  • FINEXXE will retain 20% of the revenue from the user’s manuscript sales on the FINEXXE platform. The user will receive 80% of the revenue from sales (excluding remittance and transaction fees).
  • Revenue will be paid out between the 1st and 10th of each month once accumulated revenue that has not already been paid reaches $50.
  • Users may apply to have their copyright returned to them after sales reach $5,000.
  • Users can publish on other sites after sales reach $5,000
  • FINEXXE has a minimum price of $5 for each published eBook or essay, but users may set their prices higher.
  • Publishing on FINEXXE grants the company legal permission to display the content and relinquishes us from liabilities.
  • FINEXXE reserves all other rights.

User Copyrights for FINEXXE’s Paid Editing Services Option

  • Publishing on FINEXXE grants the company legal permission to display the content and relinquishes us from all liabilities.
  • Users will retain rights to all original content.
  • FINEXXE has a minimum price of $5 for each published eBook or essay, but users may set their prices higher.
  • FINEXXE will retain 20% of the revenue from the user’s sales on the FINEXXE platform. The user will receive 80% of the revenue (excluding remittance and transaction fees).
  • Revenue will be paid out between the 1st and 10th of each month once accumulated revenue that has not already been paid reaches $50.
  • Users may remove the content from FINEXXE’s platform at any time.
  • FINEXXE reserves all other rights.

You may not publish the following content on FINEXXE:

  • Content that you have not created yourself.
  • Content to which you do not hold the copyright.
  • Content that you do not have written permission by the copyright holder to publish.

Other restrictions to what might be published on FINEXXE can be found in our Content Restriction and Guidelines document.

Publishing content on FINEXXE means the user agrees to give the company legal permission to display that content on FINEXXE for the general public to view and access. In certain cases, FINEXXE has exclusive rights to publish for a certain period. (See 4. Copyright.) Whenever the user grants FINEXXE exclusive rights to publish content, if the user publishes the same content in the same or another form on another platform during the exclusive period, this will be considered a violation of these Terms and Conditions. FINEXXE reserves the right to withhold payments and terminate the accounts of users that violate the Terms and Conditions.

The permission you grant to FINEXXE by publishing on our platform gives us the right to store, adapt, reformat, display, distribute, and sell the content. However, any content you publish to FINEXXE is your responsibility, and any liabilities that occur as a result of the content will remain with you, the user. Please read our Content Restriction and Guidelines document and our Code of Conduct document to learn how to minimize the likelihood of having liabilities attributed to your content and user account.

FINEXXE reserves the right to remove, truncate, edit or restrict publication of any content that violates our Terms and Conditions, Code of Conduct, or Content Restriction and Guidelines. We also reserve the right to terminate the accounts of users who violate these terms, codes, and guidelines.

The design, digital, and interactive elements that go into publishing content on FINEXXE should not be altered in any way. This will be considered a criminal violation and will be reported to the proper authorities. This applies to the code for our website, mobile app, and other digital media or software we use on the platform to provide our services.

FINEXXE reserves the right to alter or update these Terms and Conditions at any time and without notice, although we will make a good faith effort to notify our users of these updates whenever they are made or become effective.

FINEXXE is committed to the privacy of its users. However, under certain circumstances, we may be obligated to reveal information users provide during registration or while using the platform. Reasons for this disclosure include (but are not limited to) the following:

  • Compliance with legal investigations conducted by law enforcement or governmental agencies with jurisdiction over FINEXXE
  • Our own investigations connected to violations of the Terms and Conditions, Code of Conduct, or Content Restriction and Guidelines
  • Strengthening our security measures
  • Protecting the safety and rights of FINEXXE’s users
  • Investigation of fraudulent or malicious behavior affecting FINEXXE and its users
  • Responding to requests made by users to give technical assistance with their own FINEXXE user accounts
  1. Copyright Infringement

The United States’ Digital Millennium Copyright Act (DMCA) guides FINEXXE’s approach to determining copyright infringement and treating claims regarding such infringement. Please familiarize yourself with the DMCA and submit all claims of copyright infringement deemed to have occurred on this platform to our Support Team (info@finexxe.com). FINEXXE reserves the right to remove, truncate, edit or restrict publication of any content that violates the DMCA. We also reserve the right to terminate the accounts of users who engage in copyright infringement without a  refund, as defined by the DMCA.

FINEXXE does its best to identify and take down websites that copy content published on our platform by our users. The permissions users grant us during account registration shall include the power of acting on their behalf when taking any action necessary to have these websites, webpages, and/or the content removed.

The FINEXXE Code of Conduct gives details about the behaviors we expect from our users. The following is a non-exhaustive list of behaviors that we expect from our users:

  • Don’t violate the law by infringing on anyone’s rights—be it copyright, right to privacy, or rights to life, liberty, or the pursuit of happiness. This means:
    • no stealing content from users
    • no expressions of hate (hate speech or comments)
    • no posting or publishing of offensive or private content
    • no breaching of confidentiality or any legal obligations to FINEXXE or a third party.
  • Don’t distribute malicious software that interferes with the functioning of FINEXXE’s platforms or harms the computers or devices users use to engage with the platform. This includes the use of any means to infiltrate our databases and access private data or any sensitive material of any kind.
  • Do not steal from FINEXXE or its users by copying content, distributing content, accessing paid content without paying, selling content, or otherwise distributing it in a way that prevents its author from benefitting monetarily from that distribution.
  • Don’t duplicate or reproduce FINEXXE’s software in any way, whether by hand or by automated means. This involves scraping content, copying source code, accessing protected or private data, or copy the design or functionalities of the website and mobile application.
  • Don’t overload the platform by creating duplicate or unnecessary accounts or by uploading unnecessarily large files.
  • Don’t use bots to create artificial records, whether of views to video or visual content, “likes” to published content, or to augment reading times or watch times for content published on FINEXXE’s platform.
  • Also, do not use humans or any other means of creating artificial records. No single person should be the means of creating multiple views, read, or watch-time records on any content published on the FINEXXE platform. One person, one vote.
  1. Closing Your Account

You may close your account and delete it permanently from FINEXXE’s files. To do this, you must first deactivate your account. When an account is deactivated on FINEXXE, no one will be able to view it or the files associated with it. Comments made on other accounts using your account will remain. For six months after deactivating your account, you will be able to reactivate it. However, after six months, FINEXXE removes all the content associated with deactivated accounts, and it is no longer possible to restore the account.

Users can opt to deactivate their accounts at any time. The full deletion of the account will take six months after the most recent deactivation. Additionally, FINEXXE reserves the right to deactivate and terminate accounts for reasons covered in the Code of Conduct, Terms and Conditions, and for any other reason that we consider reasonable and appropriate. If it becomes necessary to close an account, we will notify the user via the email address associated with the account. 

  1. Indemnification

Warranty

FINEXXE provides no warranty. The user takes all risk and responsibility for the use of FINEXXE’s services in conjunction with the user’s own work. FINEXXE does not offer a warranty for using its services and takes no responsibility for loss of documents or any content posted on the website or sent to the company by electronic other means.

Responsibility

FINEXXE takes no responsibility for the content published by any of its users. Content published on or via the FINEXXE platform is the responsibility of the person or entity that created the content and/or used the platform to publish the content. Users understand that by using the service, they might be exposed to content they find offensive. We do take steps to monitor and control content with respect to plagiarism or offensiveness. However, FINEXXE cannot guarantee the validity, accuracy, completeness, veracity, reliability or intentions of any of the content published. Nor does the Company endorse any content published by users of the platform. It is impossible for the company to monitor, control, and check all content published and FINEXXE thereby returns all responsibility and liability for content to the original creators.

Liabilities

Use of FINEXXE’s services by any person represents an agreement by that user to release FINEXXE from all liability arising from your use of the platform and its associated services. The Company shall not be liable for any losses or damages whatsoever, resulting from the use of our website, services, or any materials connected with your use of these—including add-ons or plugins provided by the Company or a third party. This means FINEXXE will not be liable for ANY damages occurring as a result of:

  • Unavailability of the service due to technical difficulties or hacking
  • Loss of revenue by the user due to unavailability of the service
  • Loss of data due to unavailability or malfunctioning of the service
  • Damages accruing as a result of third-party services used in conjunction with our platform

If a user publishes content or otherwise uses the site in a way that causes FINEXXE to be sued, that user shall compensate FINEXXE and its owners for any losses suffered as a result. This includes attorney fees, lost productivity, loss of credibility, or any other financial, punitive, economic or reputation damage. By using the service, the user also agrees to make available any document or make any statements that can be used in defense against claims made toward FINEXXE as a result of that user’s use of the Service.

Links to Third-Party Services

Users follow links to third-party websites, applications, or content at their own risk. FINEXXE does not accept responsibility for any content or processes occurring as a result of a user’s navigation away from FINEXXE’s platform or for any plug-in used to enhance or alter the user’s experience on FINEXXE. We do not endorse any third-party website, applications, plugins, or content.

FINEXXE uses some features of other websites and companies to enhance its users’ experience. In those cases, a user’s use of FINEXXE’s services represents that user’s agreement to the terms set out by these third-party providers in their own terms of service documents.

Advertising

FINEXXE will display advertising of our own services and the services of third-party providers. These ads will show based on the pages users frequently read or the content they upload. FINEXXE will not take responsibility or liability for any losses users incur due to the use of advertised services or reliance on information provided during these ads. Users respond to these advertisements at their own risk. This includes any interactions with the advertisements or advertisers and any commercial or legal interactions with third parties in connection with the ads.

  1. Application of the Terms and Conditions

Changes to the Terms and Conditions

These Terms and Conditions constitute the entirety of your agreement with FINEXXE. FINEXXE reserves the right to change these Terms and Conditions at any time. Whenever we make changes, we will inform our users using the most recent contact information we have for them. Users’ continued use of our platforms indicates their consent to the updates made to the Terms and Conditions. Users who wish to be excluded from provisions contained in the updated Terms and Conditions must close their accounts and stop using FINEXXE’s services as soon as the changes take effect.

No waiver, no severability

If FINEXXE neglects to enforce any of the provisions in these Terms and Conditions, the Company still retains the right to enforce them in the future. Failure to enforce them regarding the user does not constitute a waiver given to that user. If any of the provisions become invalid or prove unenforceable, the rest of the provisions remain valid, and FINEXXE reserves the right to enforce them.

Non-transferrable Assignment

Users cannot transfer the rights or obligations given to them in these Terms and Conditions. Each user must accept these terms on their own behalf. The Terms and Conditions cannot be reassigned, sublicensed, transferred, delegated, or abnegated without FINEXXE’s express, written consent.

 

DISTRIBUTOR TERMS & CONDITIONS

WHEREAS the DISTRIBUTOR and FINEXXE wishes to enter into an agreement governing the terms and conditions of this agreement. THIS AGREEMENT WITNESSETH that in consideration of the premises and mutual covenants and agreements hereinafter contained and for other good and valuable consideration (the receipt and sufficiency of which is hereby acknowledged by the parties hereto), it is agreed by and between the parties hereto as follows:

Term of DISTRIBUTOR agreement

The agreement will be in effect for Twelve (12) months from the date the Annual Distributor Registration fee was deposited to the company’s bank account. The agreement will automatically renew annually when the Distributor Annual Membership fee is paid BEFORE the expiration date. The expiration date is defined as 12 months to the day the Distributor registration fee was paid.

IMPORTANT WARNING – If the Distributor fails to renew their membership before the expiration date, their account is automatically terminated and members in their TIERED NETWORK forfeited.

DISTRIBUTOR COMMISSION STRUCTURE :

Tutoring Account – $3,000 (JD) per new account registration

New Distributor Recruitment – $2,000 (JD) for each recruited person that pays the Distributor registration fee.

Distributor RESIDUAL commission – The Distributor shall be paid $2,000 (JD) for each of their recruited Distributor that renews their membership annually.

RESELLING OF PRODUCTS FROM FINEXXE – Registered Distributors are authorized to purchase products from FINEXXE and resell the products at any rate they desire.

INDEPENDENT CONTRACTOR – Distributor is an independent Contractor, and nothing contained in this agreement shall constitute the parties as partners, joint ventures, co-owners or otherwise, or allow Distributor to create or assume any obligation on behalf of Company for any purpose whatsoever without first consulting the company. Distributor is not an employee of the Company and is not entitled to any employee benefits. Distributor shall be responsible for paying all personal income taxes.

Indemnification by DISTRIBUTOR

DISTRIBUTOR shall indemnify and hold Company free and harmless from any and all claims, damages or lawsuits (including reasonable attorneys’ fees) arising out of negligence or malfeasant acts of Distributor or their sub-Contractor / sales representative.

Indemnification by Company

Company shall indemnify and hold Distributor free and harmless from any and all claims, damages or lawsuits arising out of defects in the Services or Products caused by Company. The Distributor is required to show the buyer that the device is 100% operational in order to prevent the buyers making false claims that defective devices were received.

DISTRIBUTOR Account Termination – The Company may terminate the agreement of the Distributor at any time:
For just cause (posting non-FINEXXE products for resale in the Store’s Product Listing, and or engaging in illegal or unethical actions), in which case the DISTRIBUTOR is not entitled to any advance notice of termination or compensation in lieu of notice, excluding outstanding commission payments.

 

PRIVACY POLICY

FINEXXE allows you to use its services in many different ways. This includes reading online, writing and publishing articles, essays, and books, sharing information via social media, communicating with others who are creating content, posting comments and reviews, and other activities. When you share content with us, for example, by filling out your author profile, we are able to customize your experience to your liking so that you get the most out of the FINEXXE experience.  While using the FINEXXE platform, it is important that you understand how FINEXXE uses the information you provide so that you know we value your privacy and offer ways for you to protect it.

The FINEXXE Privacy Policy explains:

  • The information collected by our various digital media services, including the FINEXXE website, our mobile application, and social media sites we use (such as Facebook, Instagram, LinkedIn, Pinterest, Twitter, and YouTube).
  • Why and how we collect and use that information.
  • Methods available to you for updating, accessing, and guarding your information.

Information We Collect

FINEXXE uses primary and secondary methods to collect information:

  • Primary Methods: We gather information directly from you, the user, based on the answers you provide in forms and questions we ask you directly. This includes your name, email address, credit card information, phone numbers, and other information based on your use of our services.
  • Secondary Methods: We collect information about the services that you use and how you use them, like when you watch an embedded YouTube video, visit a website that links from our website, or view and interacts with ads and content on our platform. This information includes:

We collect device-specific information (such as your hardware model, operating system version, unique device identifiers, and mobile network information, including phone number). Our system might associate your device identifiers or phone number with your FINEXXE account.

  • Log information

When you use our services or view content provided by FINEXXE, we automatically collect and store certain information in server logs. This includes:

  • details of how you used our service, such as your search queries.
  • Internet Protocol (IP) address.
  • device event information such as crashes, system activity, hardware settings, browser type, browser language, the date and time of your request and referral URL.
  • cookies that may uniquely identify your browser or your FINEXXE reader or author Account.
  • Location information

FINEXXE uses the services of certain providers (such as Facebook and Google Analytics) that may, in turn, utilize various technologies to determine your location (including IP address). As a result, when you use FINEXXE’s services, we may collect and process information about your actual location. GPS and other sensors may also furnish these providers with information on nearby devices, Wi-Fi access points, and cell towers.

  • App Numbers

Certain apps and services, such as FINEXXE’s eBook reader, include a unique application number. This number will be sent to FINEXXE when you install or uninstall that service or when that service periodically contacts our servers, such as for automatic updates. Information about your installation (for example, the operating system type and application version number) may also be sent to FINEXXE.

  • Local storage

We may collect and store information (including personal information) locally on your devices using mechanisms such as browser web storage (including HTML 5) and application data caches.

  • Cookies and similar technologies

We use Google Analytics, Facebook Insights, and other social media analytics to view and analyze the traffic to our website, social media pages, and app. We also use other third-party services, such as Instagram, Twitter, Pinterest, and LinkedIn. This information is anonymous, as it provides statistical data about users’ online activities. Below is Google’s statement about these uses:

How We Use the Information We Collect

FINEXXE uses information gathered via certain technologies (such as cookies and pixel tags) when providing you with our services. However, we will not use or share sensitive information (related to race, religion, sexual orientation, health condition, etc.) collected either directly from you or via these technologies.

Because we use services by Google, Facebook, Pinterest, and other companies, these third-party service providers may obtain information from your usage of FINEXXE’s services in order to gather their own data. These companies may use this data for their own purposes, as set out in their own privacy statements. Please consult these companies’ privacy statements for details about how they use this information, as FINEXXE cannot control that usage. As Google has noted in its own privacy statement: “Depending on your account settingsyour activity on other sites and apps may be associated with your personal information in order to improve Google’s services and the ads delivered by Google.” This includes your use of the FINEXXE platform and any applications associated with it.

We will ask for your consent before using the information for a purpose other than those that are set out in this Privacy Policy.

Transparency and choice

People’s privacy concerns vary widely. In order to fulfill your own privacy needs, you might be interested in customizing the settings of your browser (or other interfaces) while using our website, social media pages, app, or any other media related to FINEXXE. You might, for instance, prefer to set your browser so that it blocks all cookies—our cookies as well as others set by other websites. You might also be interested in being notified whenever our site attempts to set a cookie. Your browser (Firefox, Chrome, Safari, etc.) allows you to do this in different ways, depending on its type. Information you share

We collect information directly from you, such as your name, date of birth, and email address. We do this to create and personalize your FINEXXE account. We use your email only to create a unique FINEXXE account, to verify that account, and to communicate with you. We use your date of birth to ensure that you are old enough to purchase and use some of our services. Such personal information shared via forms required for services related to your account will not be shared.
